Having your financial affairs in order is not always a given. Health problems, psychological problems, debts, intellectual disability, dementia or other causes can explain why this does not work well.
Protective management is a far-reaching measure, with a great impact on your life. On one hand, it's convenient. On the other hand, it can be frustrating. No more alarming mail from debtors, but also no more independence. No debt collectors coming to your home anymore, but also no power over buying what you want.
We would like to help you solve payment problems by taking over the financial management of your household. This means that you no longer have to worry about financial problems, and can focus on things that are important to you. In addition, we also think it is important that protective management should not last longer than necessary. By giving you insight and, when the time is right, drawing up together a budget, we want to give you the tools to manage your finances independently.
If you opt for a protective regime, this practically means that your financial interests are represented by us. You will receive an allowance account with a debit card, to which we deposit an amount each week. We will hold the management account, where your income will be deposited to. From this account we pay all monthly costs and any debts.

What is protection management?
In one sentence: Financial stability and peace of mind for you. Getting under protective management is a major change in your life. Whereas you first did your own financial household, now a protective manager will do that for you.
What the protective manager does
Your protective manager will ensure that the budget will be stable again. They ensure that all bills are paid, take care of mail handling and manage any debts. This means you no longer have to worry about paying bills and financial mail.
Dealing with debts
Debt can be caused by many factors, and can consist of many different things. Think of late payments of rent, no longer being able to pay your health insurance, being cut off from gas, water or electricity, late payment on various loans, etc. Eventually, this can result in debt collection (incasso), debt collectors at home and possible confiscation (beslag) of your belongings.
The protection administrator maps out all these debts and informs the creditors that you have been placed under protective management. As a result, they will no longer send that mail to you, but to the protective manager. Debt collectors will no longer come by.
An appropriate budget
Next, we will look at the budget. How can we make the monthly and annual budget fitting? What is your income and what are your expenses? Where can we save money on and is there something that needs to be cut out completely? But it also involves checking whether you are getting your maximum rent and health care subsidy. In addition, any allowances and debts should also be accounted for, so all financial obligations can be met. In this way, the protective manager can make your household financially stable again.
Only after the budget is stable shall any debt settlement or debt commutation be considered. A debt settlement (or commutation) can be set up by the protective manager themselves. You can also contact the debt counselling service for this.
Groceries and income
You will receive an allowance account with a debit card; every week you will receive an allowance which is meant to be used for your groceries or other items. The protective manager manages the 'management account'. This is where your income is deposited to and all your monthly costs and any debts are being paid from.
Resolving debts
The protective manager writes to creditors and thus ensures that the current debts do not further increase. The protective manager can also put you in touch with possible debt counselling services. After all, resolving (high) debts is a task for debt counsellors. Consultation does take place between the protective manager and the debt counsellor.
Extra what: What does protective management cost?
The costs for protective management are determined by law. Depending on your situation, you can apply for Special Assistance (Bijzondere Bijstand) from your municipality for covering of these costs. The conditions for Special Assistance may differ per municipality and may depend on your income. As a rule of thumb, the protective manager will handle this request for you.
In 2021 the costs for protective management are €119.69 per month and for debts €154.88 per month. In addition, there are also intake costs of €676.39. Special Assistance can also be applied to the intake costs.
Who is eligible for protective management?
Protective management is for anyone who can no longer manage their finances properly. For example, this can be due to psychological problems or problematic debts. It makes no difference whether debts are private or business-related. BilancioBudget Heerhugowaard supports both forms.
According to the law, protective management is for people who are no longer able to properly arrange their finances due to problematic debts or mental reasons.
Problematic debts mean debts that cannot be repaid quickly. However, this could also be the case if you no longer have an overview of your expenses. Another sign that it might be problematic, is that you need to choose which bill to pay. I want to emphasize that you are not alone in this situation.
Examples of protective management based on mental grounds could be dementia, or another intellectual, cognitive or other disability. This group may also have informal care, for example. By protecting the financial interests of this group, the (informal) caregiver is greatly relieved.
Where do I see my protective manager?
After you've contacted us, you will be approached for an introductory meeting. This meeting is preferably at your home, but can also be at a neutral location near you, such as a community centre.
Initially, a few things will be explained, such as the first actions and consequences of being under protective management. If it is agreed that we will work together, we will sign the documents and send them to court. After the court has also agreed upon this, we will see each other regularly at your home or at a neutral location.
When does my protective management begin and end?
After we decide to work together, we will send the agreement and other documents to the court. These documents may also have to be signed by your family. The judge now has about 3 months to make a decision. Once the judge approves the application, you will be under protective management (as of the day after the judge's decision). A protective management that is based on debts usually lasts for 5 years.
Why do you want to be under protective management?
There are many different reasons for someone to want under protective management. Reasons that are often heard are ''I want peace of mind'' and ''the debts have to be paid off''. Some arguments we can give you are:
- We'll take all your mail from you. We want to prevent threatening letters from reaching you.
- We make sure bills are paid. We want to prevent your debt from expanding.
- We write to your creditors. We want to prevent debt collectors from being at your doorstep.
- We make sure you have an allowance. By agreement, you will receive X amount per week, of which you have to do your groceries or other items. You don't have to worry about other things anymore.
Mind you, everything takes time of course. It takes a while before all parties are aware of your protective order.
